Welcome to FreshShare. These Terms & Conditions ("Terms") govern your access to and use of FreshShare’s website, platform, and services.

By accessing or using FreshShare services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. About FreshShare

FreshShare is a marketing and exposure platform designed to help vacation property owners increase visibility and explore potential opportunities related to their unused vacation ownership.

FreshShare provides marketing, promotional, and lead-generation services. FreshShare is not a real estate brokerage, timeshare resale company, travel agency, or financial service provider unless expressly stated otherwise.

2. Eligibility

By using FreshShare services, you represent that:

  • You are at least 18 years old.

  • You have the legal authority to provide information regarding the vacation property, real estate property or ownership submitted to FreshShare.

  • All information provided by you is accurate and complete.

3. Services Provided

FreshShare may provide services including, but not limited to:

  • Creating and managing promotional listings.

  • Marketing exposure for vacation ownership, real estate and luxury assets opportunities.

  • Generating inquiries from interested parties.

  • Providing marketing reports and performance information.

  • Additional customized marketing programs when purchased separately.

The specific services provided may vary depending on the subscription or program selected.

4. No Guarantees of Results

FreshShare does not guarantee:

  • The sale of any vacation property, real estate or ownership interest.

  • Rental bookings.

  • A specific number of leads, inquiries, offers, or responses.

  • Recovery of any previous purchase price, fees, or expenses.

Results vary depending on multiple factors, including market conditions, location, demand, property characteristics, availability, pricing, and other circumstances outside of FreshShare’s control.

FreshShare provides marketing exposure and promotional services, not guaranteed financial outcomes.

5. Customer Responsibilities

Customers agree to:

  • Provide accurate and updated information.

  • Maintain ownership or authorization regarding any property information submitted.

  • Respond appropriately to inquiries received through FreshShare.

  • Comply with all applicable laws and agreements related to their vacation ownership.

6. Subscription Services and Billing

FreshShare offers subscription-based services that may include monthly plans.

By subscribing, you authorize FreshShare and its payment providers to charge the applicable fees according to the selected plan.

Subscription fees will continue until canceled by the customer.

Customers may cancel their subscription at any time to prevent future charges.

7. Customized Programs

FreshShare may offer customized marketing programs, including Demand Generation Programs or similar services.

Customized programs may include additional marketing strategies, campaigns, advertising services, content creation, lead generation, or other personalized services.

Due to the customized nature of these programs, services begin once the program has been accepted and initiated by FreshShare.

8. Payments and Refunds

Unless otherwise stated in writing:

  • Subscription payments are non-refundable.

  • Customized program payments are non-refundable once services have started.

  • Cancellation of future services does not qualify for a refund of previous payments.

Customers may cancel future billing according to the applicable cancellation policy.

9. Intellectual Property

All FreshShare materials, branding, website content, designs, processes, and technology are owned by or licensed to FreshShare and may not be copied, modified, distributed, or used without written permission.

10. Limitation of Liability

To the maximum extent permitted by law, FreshShare shall not be liable for indirect, incidental, special, consequential, or financial losses arising from the use of our services.

FreshShare’s total liability shall not exceed the amount paid by the customer to FreshShare during the twelve (12) months preceding the event giving rise to the claim.

11. Third-Party Services

FreshShare may use third-party services, including payment processors, communication platforms, advertising platforms, and technology providers.

FreshShare is not responsible for interruptions, errors, or failures caused by third-party providers.

12. Account Termination

FreshShare reserves the right to suspend or terminate accounts that:

  • Provide false information.

  • Violate these Terms.

  • Engage in fraudulent, abusive, or unlawful activity.

  • Harm the reputation or operation of FreshShare.

13. Changes to These Terms

FreshShare may update these Terms from time to time.

Updated Terms will be posted on this page with the corresponding revision date. Continued use of FreshShare services after changes are posted constitutes acceptance of the updated Terms.
